One-off real estate brokerage commissions shall be taxed as economic activity

The nature of income received from real estate brokerage has been clarified by the tax administration. In a recent binding ruling, the tax treatment for commissions obtained from managing real estate sales and purchases has been specified, even when these operations are not part of a regular business structure.

What the DGT has resolved

The Dirección General de Tributos (DGT) establishes that the amount received for brokerage work, even if it is a one-off and isolated operation, must be classified as income from economic activities. The tax authority's criteria distinguish between two scenarios depending on the nature of the management performed:

  • Income from professional activities: this treatment will apply if the natural person does not assume the risk and venture of the real estate operation.
  • Income from business activities: this treatment will apply if the intermediary assumes the risk and venture of the operation.

This resolution is based on the IRPF Regulation and the General Tax Law, determining that exceptionality or a lack of regularity does not exempt the income from being classified as economic activity.

What this means for you

If you are a natural person receiving a commission for having mediated in the sale of a property, you cannot treat this income as capital income or income of another nature. The regulations require that this income be included in the taxable base corresponding to economic or professional activities. This implies that the declaration of such income must comply with the tax obligations that come with exercising an activity, regardless of whether a pre-existing business structure exists.

What you should do

Upon receiving brokerage commissions, it is necessary to identify whether the management performed involves the assumption of economic risks. This distinction is fundamental to determining whether the income should be taxed as professional or business activity. It is recommended to ensure the correct integration of these amounts into the IRPF declaration to avoid possible discrepancies with the Tax Administration, always considering the specific details of the operation performed.
