A married couple who purchased their home in 2007 inquired whether they could deduct 50% of loan payments where their parents-in-law are also listed as joint borrowers. The DGT ruled that they may do so if they can prove that the payments made cover both their share of the debt and that of the other borrowers through an inter-party loan.
Cuestión planteada Vigente el régimen transitorio regulado en la disposición transitoria decimoctava de la LIRPF, posibilidad por parte del consultante y de su cónyuge de practicar la deducción por inversión en vivienda habitual, al 50% cada uno, en función de la totalidad de los pagos vinculados con el préstamo, aun ser cuatro los prestatarios, dado que la totalidad de los pagos los realizan ellos dos al ser los únicos propietarios de la vivienda.
Al existir prestatarios solidarios no adquirentes, se entiende jurídicamente que las cuotas se satisfacen por partes iguales entre los cuatro. Para que los adquirentes deduzcan la mitad de la totalidad de los pagos, deben acreditar que los otros prestatarios les prestaron el importe necesario para completar su parte de la financiación. Esta acreditación debe incluir el pacto de devolución, el tipo de interés y la cobertura de gastos, utilizando medios de prueba admitidos en derecho.
