The sale of a property with surface rights by persons over 65 may be exempt from Personal Income Tax

A person over 65 with surface rights over their primary residence inquires whether the sale of said property is tax-exempt. The DGT responds that, as the person holds full ownership of the built structure, the property is considered a primary residence and the capital gain is exempt.

The question raised

Question posed: Whether the person is entitled to the exemption provided for in Article 33.4.b) of the LIRPF.

The DGT's ruling

To apply the exemption for the transfer of a primary residence to persons over 65, ownership of the full title of the property is required, including full ownership of the built structure in cases of surface rights. As the inquirer holds full ownership of the airspace of the property, it is considered a primary residence. Therefore, the capital gain derived from its transfer is exempt pursuant to Article 33.4.b) of the LIRPF.
