Only accrued credits or those arising from successive payments and continuous relationships are subject to attachment

A taxpayer inquired whether they must report and withhold new payments to a supplier following a precautionary attachment of their credits. The Directorate-General for Tax (DGT) ruled that only credits that have already accrued but have not yet reached maturity, or those involving successive payments under continuous performance contracts or ongoing relationships, are subject to attachment.

Cuestión planteada ¿Se debe proceder a informar a la agencia tributaria de las nuevas facturas y en su caso retener el importe de estas o se debe proceder al pago al proveedor?

The DGT's ruling

Los créditos embargables son aquellos que al dictarse la diligencia ya se hayan devengado pero cuyo vencimiento no haya ocurrido, o bien aquellos que conlleven pagos sucesivos por operaciones con pago aplazado o contratos de relaciones continuadas. No es posible embargar créditos futuros aún no nacidos. Asimismo, existe el deber de colaboración con la Administración para informar sobre el surgimiento de nuevos créditos susceptibles de embargo.
