No capital gains tax applies if compensation for construction defects is used entirely for repairs

A homeowners' association sought clarification on the taxation of compensation received for construction defects and its distribution. The DGT ruled that no capital gain arises if the amount matches the cost of repairs, although any uninvested portion will be subject to tax.

The question raised

Taxation of the compensation received for the repair of construction defects in a building. Temporal imputation. Attribution to co-owners.

The DGT's ruling

The compensation received for construction defects is classified as a capital gain or loss. No gain shall be recognized if the amount received corresponds to the cost of the repairs carried out or to be carried out. If there is a surplus not allocated to the works, this shall generate a capital gain. It is recommended to apply the compensation in the same tax period as its imputation to avoid a lack of equivalence.
