Donees resident in third countries may apply the regulations of the Autonomous Community where the money is located

A US resident inquired whether they could apply Andalusian tax reliefs after receiving a cash donation from a Spanish account. The DGT ruled that, under the principle of free movement of capital, residents of third countries are also entitled to apply the regulations of the Autonomous Community where the asset is located.

The question raised

Question raised: Whether the tax reliefs existing in Andalusian legislation may be applied.

The DGT's ruling
