Accounting profit for Corporation Tax must follow the Commercial Code rather than IFRS

The taxpayer inquired whether their parent company's recognition criteria are fiscally valid to avoid making adjustments to the accounting profit. The Directorate General of Taxes (DGT) ruled that the tax base must be calculated starting from the accounting profit as determined by the Commercial Code, excluding International Financial Reporting Standards (IFRS).

The question raised

Cuestión planteada Si el criterio pretendido por la matriz responde también desde el punto de vista fiscal con un criterio válido de imputación, de acuerdo con lo dispuesto en el artículo 11 de la Ley 27/2014, de 27 de noviembre, del Impuesto sobre Sociedades, y por tanto no habría que practicar ningún ajuste al resultado contable.

The DGT's ruling

Para calcular la base imponible en el método de estimación directa, se parte del resultado contable determinado según el Código de Comercio y sus normas de desarrollo. La referencia a la normativa contable para la imputación de ingresos y gastos no incluye las Normas Internacionales de Contabilidad (NIIF).
