ITP may be settled at a value different from the Autonomous Community's if it matches the real value

A taxpayer inquired whether they could declare a value different from that set by the Autonomous Community of Castilla-La Mancha for a property occupied illegally. The DGT ruled that the tax base is the real value (normal market value) and that the regional valuation only binds that specific administration.

The DGT's ruling

La base imponible del ITP es el valor real del inmueble, concepto que se asimila al valor normal de mercado y no tiene por qué coincidir con el precio de compraventa. La valoración de la Comunidad Autónoma solo es vinculante para ella, permitiendo al obligado declarar un valor distinto siempre que sea el real. El hecho de que el inmueble esté ocupado ilegalmente no cambia el concepto de base imponible, aunque podría afectar a su cuantificación fáctica.
