Exemption from community fees in exchange for management duties classified as employment income

A property owner takes on the management of their community of owners in exchange for being exempt from paying community fees. The DGT has determined that this benefit is classified as employment income.

The question raised

Tax implications in Personal Income Tax (IRPF) regarding said exemption from fees.

The DGT's ruling

Homeowners' associations do not carry out an economic activity; therefore, the benefits received by their members do not constitute income from economic activities. The amounts received by administrators, whether in cash or through the offsetting of owed fees, are classified as income from employment pursuant to Article 17.2.e) of the Personal Income Tax Law (LIRPF). Furthermore, these associations are required to apply the corresponding withholding tax.
