SOCIMIs may carry out maintenance and construction as part of their main activities

The consultant asks whether maintenance of rented buildings and construction of property for rental can be ancillary activities of a SOCIMI. The DGT responds that these activities do not generate income separate from rental or promotion, and may therefore be carried out by the entity or its subsidiaries at 100%.

The question raised

1) Whether the activities of maintaining leased buildings and constructing buildings that it develops or rehabilitates for lease can be carried out directly by SOCIMIs as ancillary activities to their main activities of leasing and real estate development.

The DGT's ruling

The maintenance of leased buildings and the construction of buildings for lease are encompassed within the scope of the activity of real estate development for lease. Therefore, it is valid for these activities to be carried out by the consulting entity itself or by subsidiary companies that are 100% owned by it.
