Death of spouse triggers capital gain from life insurance debt cancellation

A taxpayer asks how to tax the money received from a life insurance policy after their spouse's death, used to pay off a mortgage with a remainder. Hacienda rules that the amount used to cancel the mortgage constitutes a capital gain for income tax purposes.

The question raised

Taxation of the benefit derived from the death of the applicant's spouse in the applicant's Personal Income Tax (IRPF).

The DGT's ruling

The insurance benefit must be distinguished between the portion that cancels the applicant's mortgage debt (due to the dissolution of the community property regime) and the remainder. The portion intended for the cancellation of the debt constitutes a capital gain subject to Personal Income Tax (IRPF), pursuant to Articles 33.1 and 37.1.l) of the LIRPF. Said gain must be included in the general taxable base of the tax for the amortized amount corresponding to the part of the loan allocated in the dissolution of the community property regime.
