Imputation of real estate income must be applied to the total cadastral value of the plot

A taxpayer inquired whether the imputation of real estate income should be calculated based on the value of the entire plot or only the building. The Directorate General of Taxes (DGT) ruled that the imputation must be applied to the total cadastral value of the plot.

The question raised

Request to determine whether the value of the entire plot or only that of the construction must be used for the purpose of calculating the imputation of real estate income in the Personal Income Tax.

The DGT's ruling

The imputation of real estate income provided for in Article 85 of the Personal Income Tax Law applies to the plot when it is not assigned to an economic activity nor is it a generator of capital yields. Said imputation shall be carried out on the total cadastral value of the property.
