A taxpayer inquired whether they could deduct the full mortgage repayments after being awarded 100% ownership of their home through the termination of a co-ownership agreement. The Directorate General for Taxes (DGT) ruled that the newly acquired share does not qualify for the deduction as it was acquired after 2013.
Cuestión planteada Si, por el ejercicio 2019, por la parte indivisa que adquirió en 2018, al extinguir el condominio, tiene también derecho a practicar la deducción por inversión en vivienda habitual, pudiendo comenzar a deducirse en función de la totalidad de las cantidades que satisfaga vinculadas con el préstamo. O si, por el contrario, y a partir del año en el que el cónyuge vuelve a residir en la vivienda este tiene derecho a deducirse por el 50 por ciento de las cuotas, al figurar como prestatario.
La adquisición de una nueva parte indivisa de la vivienda con posterioridad a 31 de diciembre de 2012 no permite acceder al régimen transitorio de la deducción por inversión en vivienda habitual. El contribuyente solo podría seguir aplicándola por las cantidades vinculadas a la parte adquirida con anterioridad a 2013, si ya la practicaba antes. El cónyuge pierde el derecho a la deducción desde que la vivienda deja de ser su residencia habitual o desde que transmite su propiedad, independientemente de que siga figurando como prestatario en el préstamo.
