Reinvestment exemption may apply if the new property meets the primary residence requirement

The taxpayer sold their primary residence and purchased another property that did not become their main home. They are inquiring whether they can apply the reinvestment exemption by investing the proceeds into a future property that will serve as their primary residence.

The question raised

Possibility of applying the exemption for reinvestment in a primary residence through the future purchase of a new primary residence.

The DGT's ruling

The exemption does not apply to the dwelling acquired in January 2024 because the requirement of continuous residence of at least three years was not met. However, the taxpayer shall be entitled to the exemption if they reinvest the amount obtained in the purchase of a new dwelling that does indeed qualify as a primary residence. If the reinvestment is less than the total amount obtained, only the proportional part of the gain corresponding to the amount effectively invested shall be excluded.
