Homeowners' association grants are treated as capital gains based on ownership share

A homeowner inquired whether the portion of a grant received by their homeowners' association should be declared as a capital gain. The Directorate General for Taxes (DGT) ruled that it must be imputed as a capital gain according to the individual's ownership coefficient, unless it falls under the specific exemptions provided by law.

The question raised

Whether the amount of the subsidy corresponding to the taxpayer according to their participation quota must be imputed as a capital gain or if it is exempt.

The DGT's ruling

Homeowners' associations are not taxpayers; instead, income is attributed to the owners according to their participation quota. The subsidy is characterized as a capital gain and must be imputed to the tax period in which the payment is received. The exemption only applies if the aid belongs to the specific programs mentioned in the fifth additional provision of the Personal Income Tax Law (LIRPF).
