Horizontal division and dissolution of co-ownership are operations that must be taxed independently

Co-owning siblings have enquired whether they should be taxed once for both the horizontal division and the dissolution of co-ownership, or for each act separately. The DGT has ruled that these are distinct legal agreements that must be taxed individually.

Cuestión planteada Si se debe tributar por los dos actos, extinción de condominio y división o solo se debe tributar por Actos Jurídicos Documentados una sola vez y por el 50 por cien al ser la mitad ya de su propiedad.

The DGT's ruling

La división horizontal y la disolución del condominio son hechos imponibles independientes que deben tributar por separado. La división horizontal no es una transmisión patrimonial, pero tributa por Actos Jurídicos Documentados. La disolución del condominio tributará por Actos Jurídicos Documentados si no hay excesos de adjudicación o si estos se compensan en metálico conforme al Código Civil. Si existe un exceso de adjudicación no compensado, tributará por la modalidad de transmisiones patrimoniales onerosas.
