The sale of real estate generates a capital gain or loss based on the difference in values

A query is made regarding how to calculate the capital gain or loss following the transfer of real estate. The DGT explains that the result depends on the difference between the acquisition value and the transfer value.

The question raised

Calculation of the capital gain or loss.

The DGT's ruling

The acquisition value is the sum of the actual purchase price plus expenses, taxes, and investments, reduced by depreciation. The transfer value is the actual sale price, which cannot be lower than the market value, deducting inherent expenses and taxes. In gratuitous transfers, the rules of the Inheritance and Gift Tax shall apply without exceeding the market value. The result is included in the savings tax base.
