IRPF · exención por reinversión

Reinvestment exemption cannot be applied if the property ceased to be a primary residence more than two years before the sale

A taxpayer inquired whether they could apply the reinvestment exemption after selling a property that, due to a divorce agreement, they had ceded for the use of their ex-wife and children in 2016. The DGT ruled that this is not possible because the property was neither their primary residence at the time of sale nor during the two years preceding it.

The question raised

The DGT's ruling
