Commissions may be exempt from seizure if classified as salary or wages

A query was raised regarding whether commissions received from an insurance brokerage can be seized, even if they are below the National Minimum Wage (NMW). The Directorate-General for Traffic (DGT) responded that if such commissions are classified as salary, wages, or a pension, they benefit from the same seizure exemptions as the NMW.

The DGT's ruling

Si las comisiones tienen la consideración de sueldos, salarios o pensiones según la Ley de Enjuiciamiento Civil, podrán beneficiarse de la inembargabilidad si no exceden la cuantía del salario mínimo interprofesional. El embargo de estas cantidades debe seguir las reglas de proporcionalidad y los límites establecidos en la normativa civil aplicable.
