Only one parent may file a joint tax return with all minor children

A taxpayer inquired whether they could file a joint Income Tax (IRPF) return with their two children from a current relationship, given that the mother has another child from a previous relationship. The Directorate General of Taxes (DGT) ruled that only one parent can form a family unit with the children, meaning the other parent must file an individual return.

The DGT's ruling

Las parejas de hecho no configuran unidad familiar, por lo que solo un progenitor puede optar por la tributación conjunta con los hijos. Si un progenitor elige la declaración conjunta, debe incluir a todos los hijos menores, sean comunes o no. Nadie puede formar parte de dos unidades familiares al mismo tiempo. La opción por la tributación conjunta debe abarcar a la totalidad de los miembros de la unidad familiar.
