Residents in France renting property in Spain subject to 19% Non-Resident Income Tax

A tax resident in France has requested clarification regarding their tax obligations when renting a property in Madrid via a collaborative platform. The Directorate General for Taxes (DGT) ruled that the income is subject to Non-Resident Income Tax (IRNR) in Spain and analysed the potential withholding obligations of the platform.

The DGT's ruling

España puede gravar las rentas de bienes inmuebles situados en su territorio según el CDI España-Francia. El contribuyente tributará por el IRNR, con un tipo del 19% por ser residente en la UE. Se podrán deducir gastos según la normativa del IRPF siempre que tengan vínculo económico directo con la actividad en España. La plataforma solo estará obligada a retener si no actúa como mera mediadora de pago.
