A query was raised regarding whether the transfer of real estate in a judicial auction for the IIVTNU is deemed to take place on the date of the adjudication order or on the date of taking possession. The DGT ruled that the transfer occurs on the date the certificate issued by the Court Clerk regarding the adjudication decree is granted.

El IIVTNU se devenga en la fecha de la transmisión de la propiedad. En el caso de adjudicación judicial en un procedimiento de ejecución, la transmisión se produce en la fecha en que se dicta el testimonio expedido por el Secretario Judicial, comprensivo del auto de adjudicación. Este testimonio es título bastante para la inscripción del dominio en el Registro de la Propiedad.
