Loss can be calculated by deducting insurance payout from acquisition value

The consultant asks whether a patrimonial loss can be recognised after the theft of a jewel, given that the insurance payout is below the item's value. The DGT confirms that theft constitutes a patrimonial loss and explains how to calculate it.

The question raised

Possibility of computing a capital loss.

The DGT's ruling

The capital loss is determined by the difference between the acquisition value of the jewelry and the compensation received. From the acquisition value, the proportional part of the depreciation due to use must be subtracted, as losses due to consumption are not deductible. The existence of the loss must be substantiated through the means of proof admitted under Law.
