Amounts paid by an employer to cover special social security agreement contributions constitute monetary employment income

An employee received funds from their former employer to pay contributions for a special social security agreement. The Directorate-General for Taxes (DGT) has ruled that this amount constitutes monetary employment income, but it is also a deductible expense.

The DGT's ruling

The payment of amounts by the company for the employee to pay the contributions to the special agreement, which are the exclusive responsibility of the employee, constitutes full cash employment income pursuant to Articles 17.1 and 42.1 of Law 35/2006. Notwithstanding, said contributions shall be considered deductible expenses for the purpose of determining net employment income, in accordance with Article 19.2.a) of the same law.
