Imputation of rental income calculated as a percentage of cadastral value

The DGT confirms that the imputation of rental income in personal income tax must be based on the cadastral value, not the succession value.

The question raised

It is requested to know whether, for the calculation of the imputation of real estate income for Personal Income Tax purposes, the cadastral value or the value recorded for Inheritance and Gift Tax purposes must be used.

The DGT's ruling

For urban real estate not used for economic activities nor generating returns on capital, the imputed income is 2 percent of the cadastral value. If the municipality has revised cadastral values within the last ten tax periods, the percentage shall be 1.1 percent. In the absence of a notified cadastral value, 1.1 percent shall be applied to 50 percent of the higher value between that verified by the Administration or the acquisition value.
