Termination of co-ownership subject to Stamp Duty and Capital Gains Tax if there is an excess of adjudication

A taxpayer wishes to acquire full ownership of a property currently held in 50% shares, by assuming the mortgage and paying a cash sum to the other co-owner. The DGT indicates that the transaction may trigger two types of taxation: for the dissolution of the co-ownership community and for the excess of adjudication if this is not compensated in accordance with the law.

La disolución de una comunidad de bienes que no realiza actividades empresariales tributa por actos jurídicos documentados si se realiza por escritura pública, siendo el sujeto el comunero que recibe el inmueble. Si existe un exceso de adjudicación, este tributará por transmisiones patrimoniales onerosas si es oneroso, o por sucesiones y donaciones si es lucrativo. Para que el exceso de adjudicación no tribute, la compensación debe realizarse en dinero, considerando el valor de mercado del inmueble.
