Residents in Spain must include foreign property income in their IRPF, applying progressive exemption

A Dutch citizen resident in Spain enquires about the taxation of the sale of a property in the Netherlands. The DGT explains that as a fiscal resident in Spain, he must pay tax on worldwide income, but the Spain-Netherlands double taxation treaty allows avoidance of double taxation through a progressive exemption.

The DGT's ruling

Si el consultante es residente fiscal en España, debe tributar por el IRPF sobre su renta mundial, incluyendo las ganancias de inmuebles en el extranjero. Según el Convenio entre España y los Países Bajos, estas ganancias pueden tributar en el país donde se sitúe el inmueble. En España, se aplicará la exención de dichas rentas, pero se tendrán en cuenta para calcular el tipo impositivo aplicable al resto de sus rentas (exención con progresividad).
