Reinvestment exemption inapplicable if new home is acquired outside the two-year period

A taxpayer purchased a new home and moved into it before selling their previous primary residence. The DGT has ruled that the reinvestment exemption cannot be applied because the purchase of the new property occurred outside the two-year window prior to the sale, following an assessment of the suspension of deadlines due to COVID-19.

The question raised

Whether the exemption for reinvestment is applicable.

The DGT's ruling

For the exemption, the new dwelling must be acquired within a period of two years prior to or following the transfer of the old one. The calculation of these periods was suspended from March 14, 2020, to May 30, 2020, due to COVID-19 regulations. In this case, the acquisition of the new dwelling was not carried out within the period of two years prior to the transfer of the old one, after applying said suspension.
