Cannot deduct 100% of mortgage if only 33.33% of property ownership held

A taxpayer asks whether they can deduct the full amount of a joint mortgage payment when they own only one-third of the property. The DGT responds that the deduction is tied to property ownership and allows deduction only for the proportion of ownership held.

The question raised

Question posed: Being the only person paying the joint loan among three people and a co-owner of 33 percent, the possibility of applying the deduction based on 100 percent of the amounts satisfied.

The DGT's ruling

The tax benefit for investment in a primary residence is linked to the ownership of full title to the property. Even if the loan is joint and only one co-owner pays the entirety of the installments, the basis for the deduction is limited to the percentage of ownership held by the taxpayer over the dwelling. In this case, as the owner of an undivided one-third interest, she may only apply the deduction to 33.33% of each payment made.
