Homeowners' community grants are treated as capital gains for Personal Income Tax purposes

A homeowner inquired whether a grant received by their community of owners to improve energy efficiency should be included in their Personal Income Tax (IRPF) taxable base. The Directorate General for Taxes (DGT) ruled that the grant is attributed to each owner as a capital gain in the year it is received.

The question raised

Integration of said subsidy into the taxpayer's taxable base.

The DGT's ruling

Homeowners' associations are not taxpayers; instead, income is attributed to their members according to their participation coefficient. The subsidy received is of the nature of a capital gain. This must be imputed to the tax period in which the collection occurs, being attributed to whoever is the owner at that time.
