Analysis of the nature of the income of a Commonwealth and its possible liability to VAT

A municipal association has requested clarification on whether the repair and leasing services it provides to its members are subject to VAT. The Directorate General for Taxes (DGT) indicates that if the consideration is of a tax nature or if the conditions of the Public Sector Contracts Law are met, the services will not be subject to the tax.

The question raised

Question posed: Whether such provision of services carried out by the applicant in favor of its members is subject to Value Added Tax.

The DGT's ruling

The provision of services by a community of municipalities to its constituent municipalities shall not be subject to VAT if the consideration is of a tax nature. Likewise, services provided by public sector entities in favor of the Administrations to which they belong shall not be subject to VAT, provided that the latter hold full ownership of the same pursuant to the Public Sector Contracts Law. If the consideration is not of a tax nature, the provisions shall be subject to the tax.
