Storage rooms and up to two parking spaces may qualify for main residence reinvestment exemption

A taxpayer inquired whether funds allocated to purchasing a new home, a storage room, and several parking spaces could qualify for the reinvestment exemption. The Directorate General for Taxes (DGT) ruled that a storage room and up to two parking spaces are treated as part of the dwelling, provided they are acquired in the same transaction and within the same building.

The question raised

Whether, for the purposes of applying the exemption for reinvestment in a primary residence, the amounts allocated to the acquisition of the new primary residence, which includes a garage space and a storage room, as well as the acquisition of a second garage space, can be considered as a reinvested amount.

The DGT's ruling

In order for the storage room and garage spaces to be assimilated to the primary residence, they must be located in the same building or real estate complex. The acquisition of all these elements must occur in the same transaction, even if they appear in different documents, and must be for the private use of the acquirer. Under these conditions, the storage room and a maximum of two garage spaces are considered reinvested amounts for the exemption.
