Lease expenses may be deducted from income from movable capital through subletting

A taxpayer inquired whether they could deduct the rental cost of a property from which they derive income by subletting it for tourist use. The Directorate General for Taxes (DGT) responded that, as this constitutes income from movable capital, it is possible to deduct the expenses necessary to obtain it, including the amount paid to the landlord.

The question raised

Requests to know whether the amounts paid for the lease of the dwelling generating the income may be deducted from the aforementioned income from movable capital.

The DGT's ruling

Income derived from subletting that does not constitute an economic activity is classified as income from movable capital. To determine the net income, the expenses necessary for its acquisition may be deducted, which includes the amounts paid to the owner for the lease of the property. This deduction may only be applied to the expenses corresponding to the period during which the property has been sublet.
