Reinvestment exemption possible if new home purchased within two years of selling previous one

The consultant asks whether the reinvestment exemption can be applied when acquiring a commercial property first, converting it to residential use, and then selling the current home. The DGT confirms it is possible as long as the conditions for habitual residence and reinvestment periods are met.

The DGT's ruling

La exención es aplicable si la nueva vivienda se adquiere en el plazo de dos años anteriores a la transmisión de la vivienda habitual. No es necesario que el dinero utilizado sea exactamente el obtenido por la venta, ya que el dinero es un bien fungible. Para que el inmueble comercial sea considerado vivienda habitual, debe estar acondicionado o ser susceptible de serlo, cumpliendo los requisitos de titularidad, residencia efectiva y permanencia. La acreditación de que el inmueble es la vivienda habitual es una cuestión de hecho que debe probar el contribuyente.
