Cash in trading accounts and shares in foreign funds must be declared if they exceed €50,000

A taxpayer inquired whether they must report a trading account held with a Maltese broker for CFD and forex trading, as well as shares in a sub-fund. The Directorate General for Taxes (DGT) ruled that while derivatives themselves do not need to be reported, the cash held in the account and the shares in the fund are subject to reporting obligations, subject to independent thresholds.

The DGT's ruling

Los CFD y contratos de divisas son instrumentos derivados y no se incluyen en la obligación del artículo 42 ter del RGAT. El efectivo en la cuenta de trading debe informarse según el artículo 42 bis del RGAT, identificando al bróker. Las acciones en instituciones de inversión colectiva deben informarse según el artículo 42 ter del RGAT. Existen dos límites de 50.000 euros independientes para determinar la obligación de informar sobre el efectivo y sobre los valores.
