Capital gains and losses may only be offset if legal ownership belongs to the taxpayer

The taxpayer inquired about the amount of negative capital gains and losses from 2017 and 2018 that could be offset in their 2019 tax return. The DGT ruled that only the portion of such balances for which the taxpayer holds legal ownership, in accordance with the ownership rules of the Personal Income Tax Act (LIRPF), may be offset.

The DGT's ruling

El contribuyente solo puede compensar en su declaración la parte del saldo negativo de ganancias y pérdidas patrimoniales de ejercicios anteriores cuya titularidad jurídica le corresponda según el artículo 11 de la LIRPF. No puede compensar la parte del saldo cuya titularidad jurídica pertenezca a su cónyuge. La titularidad se determina según las normas sobre titularidad jurídica de los bienes o derechos, incluyendo el régimen económico matrimonial.
