A taxpayer inquired whether they could claim a 67.50% deduction on their mortgage loan after acquiring 100% ownership of their home following a divorce. The Directorate General for Taxes (DGT) ruled that, provided specific requirements regarding previous ownership shares and the former spouse's rights are met, the taxpayer may deduct 100% of the amounts paid.

Para la parte de la vivienda adquirida tras 2012 por extinción de condominio, el contribuyente podrá aplicar la deducción si su ex cónyuge hubiera practicado la deducción por su parte antes de 2013 y no hubiera agotado su derecho. En ese caso, la deducción se aplicará sobre las cantidades satisfechas por el 100% del préstamo, con el límite del importe que el ex cónyuge habría podido deducirse de no haberse producido la extinción. La parte de la vivienda adquirida antes de 2013 mantiene su derecho al régimen transitorio si se cumplieron los requisitos previos.
