Cost and completion date of works must be proven to calculate capital gains

A taxpayer has enquired about how to determine the acquisition value of a property built in 1988 for which no invoices are available. The DGT explains that the acquisition value includes the cost of the land and the construction works, but these must be substantiated by the interested party.

The question raised

Acquisition value for the purposes of calculating the corresponding capital gain in the Personal Income Tax (IRPF).

The DGT's ruling

In the direct execution of works, the acquisition value is the sum of the amount of the land, the cost of the works, and the inherent expenses and taxes. The cost of the works and their completion date must be accredited by the taxpayer through any valid means of proof. If the completion date cannot be accredited, the date of the deed of declaration of new construction shall be used.
