It is possible to break down the total value of an inheritance to determine the acquisition value for IIVTNU

The consultant asks whether the joint valuation of assets in an inheritance prevents applying exemption or reduction of IIVTNU taxable base. The DGT responds that the total value can be broken down using a logical method, such as the proportion of cadastral values.

The question raised

Question raised 1.- Whether the joint or global valuation of several assets in an inheritance prevents the determination of the acquisition value of each one for the purposes of applying, where applicable, the provisions of articles 104.5 and 107.5 of the TRLRLHL.

The DGT's ruling

If there is no breakdown in the titles or in the Inheritance and Gift Tax return, the breakdown of the global value among the assets must be carried out using a logical method admitted under Law. An example is applying the proportion represented by the cadastral value of each property relative to the sum of the cadastral values of all properties. For the calculation of the land value, said proportion shall be applied to both the transfer value and the acquisition value.
