Reinvestment exemption for principal residence requires full ownership

A taxpayer inquired whether he and his children could apply the reinvestment exemption when selling a property in which he holds the usufruct and half of the full ownership, while his children hold the bare ownership. The Directorate General of Taxes (DGT) ruled that the exemption can only be applied to the portion of the full ownership held by the taxpayer, provided that the reinvestment requirements are met.

The question raised

The DGT's ruling
