Reinvestment exemption applicable if the sold property was the primary residence in the two years prior to sale

A taxpayer inquired whether they could apply for the reinvestment exemption after selling a property that ceased to be their primary residence in 2018 due to a family accident. The Directorate General of Taxes (DGT) ruled that this is possible, provided that the required timeframes and reinvestment amounts are met.

The DGT's ruling

Para aplicar la exención, la vivienda transmitida debe ser la vivienda habitual en el momento de la venta o haberlo sido en cualquier día de los dos años anteriores. En este caso, al haber sido residencia habitual hasta mayo de 2018 y venderse en febrero de 2020, se cumple el requisito. La exención estará condicionada a que se reinvierta el importe obtenido en la adquisición de una nueva vivienda habitual en un plazo no superior a dos años.
