A company inquired whether it could convert deferred tax assets into an enforceable claim against the Administration following the dissolution of the company. The DGT ruled that, as credit impairments are tax-deductible, they do not generate a deferred tax asset.
Cuestión planteada Si en la declaración del Impuesto sobre Sociedades correspondiente al ejercicio 2014, en virtud de la Disposición adicional vigésimo segunda, Conversión de activos por impuesto diferido en crédito exigible frente a la Administración Tributaria de la LIS, la entidad consultante ¿podría solicitar la conversión de esos activos por impuestos diferidos generados y contabilizados en un crédito exigible frente a la Administración Tributaria, al darse el supuesto contemplado en el apartado b) del punto 1 de la referida disposición adicional y su abono a la citada Administración tributaria?
Los deterioros de créditos concedidos a clientes no vinculados en concurso de acreedores son fiscalmente deducibles según el artículo 12.2.b del TRLIS. Al ser deducibles, estos deterioros no dan lugar a la generación de un activo por impuesto diferido. Por tanto, no resulta de aplicación ni el artículo 19.13 ni la disposición adicional vigésima segunda del TRLIS.
