No income in kind if employee mortgage conditions are replaced with standard terms

An employee of a bank asks whether income in kind ceases when her mortgage conditions of employment are replaced with standard customer terms. The DGT responds that, as there are no advantageous conditions due to her employment status, no income in kind arises.

The question raised

Question posed: Existence of in-kind employment income for Personal Income Tax purposes.

The DGT's ruling

Loans with interest rates below the market norm constitute benefits in kind as employment income. However, if the advantageous employee conditions are removed and replaced by rates offered to the general public, the benefit in kind ceases to exist. The valuation of the benefit in kind for financial institutions must be the price offered to the public, deducting ordinary or common discounts.
