Awarding indivisible assets to a single co-owner attracts AJD tax, except for avoidable excess which attracts ITP

The taxpayer sought clarification on whether the dissolution of a joint ownership (a house and a garage) by awarding both to a single sibling, with financial compensation, was subject to Documented Legal Acts (AJD) tax. The DGT ruled that, as these are independent assets, the unavoidable excess is subject to AJD, whereas any avoidable excess is subject to Transfer Tax (ITP).

The DGT's ruling

La disolución de la comunidad no es transmisión si el comunero no recibe más de su cuota. Si hay exceso de adjudicación, este tributa por ITP, salvo que sea inevitable por indivisibilidad del bien y se adjudique a uno solo con compensación en metálico, caso en que tributa por AJD. Al ser dos fincas independientes, el exceso por la vivienda (inevitable) tributa por AJD, pero el exceso por el garaje (evitable mediante reparto) tributa por ITP.
