No applicable: 30% capital reduction for collective pension insurance benefits

The consultant asks whether a 30% reduction on capital receipts from a collective pension insurance can be applied. The DGT responds that such benefits are considered income from employment under article 17.2.a) 5. of the LIRPF and thus are excluded from the reduction.

The question raised

Whether it is appropriate to apply the 30 percent reduction provided for in Article 18.2 of the Personal Income Tax Law to the capital received.

The DGT's ruling

Benefits from collective insurance contracts that implement pension commitments are classified as employment income pursuant to Article 17.2.a) 5. of the LIRPF. Article 18 of the LIRPF establishes a 30% reduction for certain types of income, but expressly excludes those provided for in Article 17.2.a). Therefore, the 30% reduction is not applicable to the amount received from said insurance.
