VAT rate for electricity supply depends on when price becomes due

The consultant asks whether the reduced 10% VAT rate applies to electricity consumed by end of 2024, even if the invoice is issued in 2025. The DGT replies that the due date is determined by when the price becomes due under the contract, regardless of when the energy was consumed.

The question raised

Possible application of the reduced VAT rate of 10 percent to the electricity supply carried out until December 31, 2024.

The DGT's ruling

In continuous supply operations, such as electricity supply, the accrual of VAT occurs at the moment when the agreed portion of the price becomes due. This moment of exigibility is determined by the terms established in the contract, regardless of the period in which the consumption occurred or the timing of the payment.
