Dissolution of two distinct hereditary communities subject to AJD tax if avoidable excesses of adjudication occur

A taxpayer has enquired about the procedure for dissolving the joint ownership of properties inherited from their grandparents. The DGT clarifies that there are two distinct communities involved and that taxation will depend on whether the partition results in excesses of adjudication or exchanges between them.

The DGT's ruling

Al existir dos comunidades hereditarias diferentes, su disolución debe tratarse por separado. Si la disolución de cada comunidad no genera excesos de adjudicación evitables y no se compensan bienes de una comunidad con la otra, solo tributará por actos jurídicos documentados. Si se producen excesos de adjudicación no inevitables o se intercambian bienes entre comunidades, se devengará también la modalidad de transmisiones patrimoniales onerosas.
