The obligation to issue invoices varies according to the VAT regime and the method of determining income for Personal Income Tax purposes

A query was raised regarding whether members of a hospitality association engaged in vending activities are required to issue invoices. The Directorate General for Taxes (DGT) ruled that the obligation depends on the specific VAT regime applied and the method used to calculate income for Personal Income Tax (IRPF) purposes.

The question raised

Question posed: Whether the taxpayer's members are obliged to issue invoices for the activities of "retail sale of tobacco through vending machines" or "food and beverage vending machines".

The DGT's ruling

Entrepreneurs under the general VAT regime are obliged to issue invoices for their operations. Taxpayers under the equivalence surcharge regime have no general obligation to issue invoices, unless the recipient is an entrepreneur or professional. However, if taxpayers determine their income for Personal Income Tax purposes using the direct estimation method, they are obliged to issue invoices regardless of their VAT regime. For retail sales or hospitality services, the use of simplified invoices is permitted if the amount does not exceed 3,000 euros.
