Reinvestment exemption applicable if sold property was main residence for at least three years

The taxpayer inquired whether they could apply for the reinvestment exemption after selling their main residence. The DGT ruled that, as they had resided in the property from October 2019 to April 2023, they meet the minimum three-year residency requirement.

The question raised

Whether the exemption for reinvestment in a primary residence can be applied to the gain generated in the sale.

The DGT's ruling

For the exemption, both the transferred and the acquired housing must be primary residences, understood as continuous residence for at least three years. The reinvestment of the amount obtained must be carried out within a period of two years prior to or following the disposal. If the reinvestment is less than the total amount obtained, only the proportional part of the gain corresponding to the amount invested shall be excluded.
