Partial renting of new home may reduce reinvestment relief

A taxpayer inquired whether renting out two rooms in their new home would affect the reinvestment relief applicable to the capital gains from their previous primary residence. The Directorate General for Taxes (DGT) ruled that if the taxpayer resides there permanently but rents out part of the property, only the proportional amount corresponding to the part used for private purposes will be considered exempt.

Cuestión planteada Si perdería el derecho a la exención ya aplicada en el caso de que pase a alquilar dos habitaciones de la nueva vivienda adquirida.

The DGT's ruling

Para mantener la exención, la nueva vivienda debe ser la residencia habitual, lo que requiere una utilización efectiva y permanente por el contribuyente. Si se arrienda parcialmente la vivienda mientras se reside en ella, solo podrá considerarse importe reinvertido la parte del valor de adquisición que proporcionalmente corresponda a la parte de la vivienda que el contribuyente utilice de forma privada, incluyendo las zonas comunes.
